Terms & Conditions

1. Scope

These Terms and Conditions (T&C) apply to all contracts between KLARER Academy and customers for the provision of language training and coaching services.

2. Contract Formation

2.1 Booking

The contract is formed through booking a trial lesson or package via Calendly and confirmation by KLARER Academy.

2.2 Contract Language

The contract language is German or English.

3. Services

3.1 One-on-One Lessons

KLARER Academy offers individual German lessons (one-on-one) for various levels (A1–C1).

3.2 Group Courses

KLARER Academy offers group courses with a maximum of 6 participants. Group courses take place only with a minimum of 4 participants.

3.3 Corporate Training

Individual corporate packages are offered by arrangement.

4. Prices and Payment

4.1 Prices

Current prices can be viewed on the website at /en/leistungen. All prices include statutory VAT.

4.2 Payment Terms

Payment is made:

• Single lessons: After each session
• Packages: In advance after invoicing
• Group courses: Before course start

Payment methods: Bank transfer

4.3 Late Payment

Late payment interest is charged at the statutory rate.

5. Cancellation and Withdrawal

5.1 One-on-One Lessons

Cancellations must be made at least 24 hours before the scheduled appointment. Later cancellations will be charged.

5.2 Packages

Booked packages are valid for 6–18 months (depending on package). Refund of unused sessions is excluded.

5.3 Group Courses

Group courses can be cancelled up to 14 days before the start. Thereafter, the full course fee is due.

5.4 Cancellation by KLARER

In case of cancellation by KLARER Academy, a replacement appointment will be offered or the lesson credited.

6. Implementation

6.1 Location

Lessons take place online via video call or by arrangement in Vienna.

6.2 Teaching Materials

KLARER Academy provides necessary teaching materials.

6.3 Minimum Participants for Group Courses

Group courses take place only with a minimum of 4 participants. If the minimum is not reached, KLARER Academy reserves the right to cancel or postpone the course. In this case, the course fee will be fully refunded.

7. Relocation Services

7.1 Scope of Services

KLARER offers relocation services for individuals moving to Vienna. Specific services and prices are defined on the Relocation page.

Relocation Services include:

• Advice on districts, apartment search, schools, kindergartens
• Accompaniment to viewings and government offices
• Support with registrations (registration certificate, bank account, E-Card, etc.)
• Orientation help for daily life in Vienna
• Utilities setup (electricity, gas, internet, mobile phone)

Relocation Services do NOT include:

• Legal advice within the meaning of the Austrian Bar Act (RAO)
• Guarantee of apartment allocation, school place, or official approval
• Coverage of costs (rent, broker fees, government fees, travel expenses)

7.2 Contract & Payment

The contract is formed through booking and down payment.

Payment terms:

• 50% down payment upon booking
• 50% remaining payment no later than 7 days before the start of on-site support in Vienna

Payment methods: Bank transfer, PayPal, credit card

7.3 Cancellation

Cancellation by customer:

• Up to 30 days before planned arrival: 100% refund minus €200 processing fee
• 14–29 days before arrival: 50% refund
• Less than 14 days before arrival: No refund

Cancellation by KLARER:

In case of unforeseen circumstances (illness, etc.): Full refund or rescheduling

7.4 Liability & Warranty

KLARER does not guarantee:

• Availability of apartments, school places, or kindergarten places
• Success of official applications (residence permit, registration, etc.)
• Decisions by third parties (landlords, brokers, schools, authorities)

KLARER is not liable for:

• Delays caused by external factors (authorities, brokers, etc.)
• Costs for accommodation, travel, government fees, broker commissions
• Rejections of apartment applications or school registrations

KLARER provides the best possible advice and support, but no guarantee of success. In case of negligent breach of duty, KLARER is only liable for foreseeable, contract-typical damages. Liability for slight negligence is excluded.

7.5 Immigration & Visa Guidance

KLARER provides orientation on residence permits but does not replace legal advice. For complex visa cases (non-EU citizens, family reunification, etc.) we refer to specialized lawyers. KLARER assumes no liability for rejected visa applications.

7.6 Data Protection

The following personal data is processed for Relocation Services:

• Name, date of birth, contact details
• Marital status, number and ages of children
• Professional situation, budget
• Preferences (districts, school types, etc.)

This data is used only for the service and not shared with third parties unless with explicit consent (e.g. contact with brokers, schools). For detailed information see our Privacy Policy.

7.7 Final Provisions

The general provisions of these T&C (jurisdiction: Vienna, Austrian law, etc.) also apply to Relocation Services.

8. Customer Obligations

The customer commits to:

• Attend scheduled appointments punctually
• Provide technical requirements for online lessons
• Actively participate in lessons

9. Liability

9.1 Limitation of Liability

KLARER Academy is not liable for damages caused by force majeure, technical disruptions (in online lessons), or customer fault.

9.2 Exam Success

KLARER Academy does not guarantee passing language exams.

10. Copyright

All teaching materials are protected by copyright. Distribution to third parties is not permitted.

11. Data Protection

Personal data processing is conducted according to our Privacy Policy.

12. Final Provisions

12.1 Changes to T&C

KLARER Academy reserves the right to modify these T&C. Customers will be informed of changes via email.

12.2 Severability Clause

Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected.

12.3 Applicable Law

Austrian law applies.

12.4 Place of Jurisdiction

Place of jurisdiction is Vienna.
